GENERAL TERMS AND CONDITIONS OF SALE

1. Premise
The following General Terms and Conditions set out the terms and conditions under which KEY WORD GmbH – with its registered office at 1080 Vienna, Wickenburggasse 4 Top 1, registered in the Commercial Register of Vienna under FN 436077 s and VAT number ATU69754704 – hereinafter referred to as “Keyword”, sells products via the website accessible at https://cambiocaffe.com (hereinafter referred to as the “Website”).
The purchase by the customer of any product via the Website shall take place in accordance with the procedures and conditions set out in these General Terms and Conditions of Sale.
2. Definitions
2.1 The following terms shall have the meanings set out below wherever used in these General Terms and Conditions, the privacy information, and annexes:
2.1.1 “General Terms and Conditions of Sale” and/or “GTC”: These General Terms and Conditions of Sale
2.1.2 “Customer”: The natural or legal person who accepts the GTC by selecting the relevant checkbox (“flag”) in the online order form on the Website
2.1.3 “Contract”: The proposed sales contract between Keyword and the Customer for the sale of products via the Website, governed by these GTC
2.1.4 “Conditions of Sale”: All provisions governing the contractual relationship for the sale of products, including quantity, description of technical characteristics, delivery times, and payment
2.1.5 “Consumer”: A natural person acting outside the scope of any professional or business activity
2.1.6 “Email”: The email address provided by the Customer when concluding the contract
2.1.7 “Party” or “Parties”: Keyword and the Customer, individually or jointly
2.1.8 “Website”: The website owned by Keyword and accessible at http://shopat.cambiocaffe.com
2.1.9 “Order Form” and/or “Order”: A purchase request for a product and/or service
3. Conclusion of Contract
3.1 The contractual offer submitted by the Customer by paying the amount corresponding to the selected products shall be considered confirmed once accepted by Keyword. The contract shall be deemed tacitly accepted unless Keyword informs the Customer otherwise. Keyword reserves the unquestionable right to accept an order.
3.2 The contract between the Parties is deemed concluded once accepted by Keyword. Confirmation may be sent to the email address provided by the Customer and, unless otherwise communicated, the contract shall be considered tacitly accepted. Keyword reserves the right not to accept the contract, including but not limited to the following cases:
3.2.1 The Customer fails to provide requested documentation or provides incorrect data
3.2.2 Technical, organizational, or other reasons prevent the conclusion of the contract
3.3 Keyword is not obliged to justify the rejection of an order. The Customer shall not be entitled to compensation, damages, or any other claims. In case of rejection, Keyword is only obliged to refund any amounts received, without additional charges or interest.
3.4 If the Customer is a Consumer, they may save or print a copy of these GTC. Keyword will provide the GTC as a downloadable PDF file.
4. Costs
4.1 All prices on the Website exclude VAT, including booking services, such as barista catering and barista workshops
4.2 Keyword reserves the right to change prices at any time without prior notice
4.3 In the event of pricing errors (e.g., human or system errors), Keyword may cancel the order, inform the Customer, and refund any amounts received
5. Order Confirmation
5.1 After submitting the order form, the Customer will receive an order confirmation via email
6. Non-Acceptance of Order and Availability
6.1 If Keyword does not accept an order, the Customer will be informed
6.2 The available quantity for each item is indicated on the Website
6.3 The Customer acknowledges that simultaneous access by multiple users may affect actual availability
7. Purchase Procedure
7.1 The Customer may only purchase products available on the Website
7.2 Keyword reserves the right to change technical specifications in line with manufacturer information
7.3 Images are for illustrative purposes only and may differ from the actual product
8. Payment Methods
8.1 Credit Cards
Payment is authorized at the time of the transaction
Accepted cards: Visa, Mastercard, Visa Electron
If authorization fails, the purchase is not completed
In case of cancellation, the amount will be released
Keyword may request additional documentation
If not provided, the order may be canceled
Payments are processed via Huellemann & Strauss Onlineservices S.A
Keyword does not store credit card data
8.2 Prepaid Credit Cards
Same conditions as above
Accepted cards: Visa, Mastercard
Keyword does not store card data
8.3 Sofortüberweisung (Instant Bank Transfer)
Payment is authorized at transaction completion
If authorization fails, the purchase is not completed
In case of cancellation, the amount will be refunded
Payment is processed via the Customer’s bank
Keyword does not store bank data
9. Delivery of Purchased Products
9.1 Delivery is limited to Austria
9.2 Delivery is carried out via partners or couriers
9.3 Delivery times are indicative and non-binding
9.4 Keyword is not liable for delivery delays
9.5 Delivery costs are borne by the Customer unless stated otherwise
9.6 Costs are indicated in the product summary
9.7 The Customer must inspect the package upon delivery
9.8 In case of irregularities:
Visible damage must be reported immediately; hidden damage within six days
Claims against the carrier expire after six months
Keyword must be notified within six days via email
Failure to notify excludes claims
10. Withdrawal
10.1 Consumers have the right of withdrawal as stated in the cancellation policy available on the Website
11. Legal Disputes and Jurisdiction
11.1 Austrian law applies
11.1.1 For Consumers: jurisdiction is the Customer’s place of residence
11.1.2 For non-consumers: jurisdiction is Keyword’s registered office
12. Statutory Warranty
12.1 Businesses
Goods must be inspected within a reasonable time
Defects must be reported within one week
Warranty period: 12 months
12.2 Consumers
Visible defects should be reported within 14 days
Warranty period: 24 months
Replaced parts: 12 months warranty
12.3 Return Costs
Customer bears return shipping costs and risks
12.4 Exclusions
12.4.1 Improper use
12.4.2 Lack of maintenance
12.4.3 Unauthorized repairs
12.4.4 Non-covered repairs charged (€92/hour incl. VAT, minimum 30 minutes)
13. Cancellation by Keyword
Keyword reserves the right to cancel bookings for services, including but not limited to barista courses, catering, or similar services, for important reasons. This applies in particular in cases of unforeseen events, organizational issues, or insufficient participant numbers. In such cases, the customer shall not be entitled to any claims for damages. Any payments already made will be fully refunded.
14. Limitation of Liability
Liability for slight negligence, consequential damages, financial losses, lost profits, and third-party claims is excluded. Exceptions apply only in cases of intent or gross negligence, or for personal injury or death attributable to Keyword.
15. Amendments to the Contract
15.1 These General Terms and Conditions may be amended by Keyword at any time without prior notice. The amended version becomes valid upon publication on the Website.
